In the eight-year-old pending case of late Bollywood actress Jiah Khan’s death, it has been decided that a special CBI court will now hear the case. The sessions court, which was conducting a trial against the late actress’ boyfriend, Sooraj Pancholi, on charges of alleged abetment, has said that the case should be transferred to a special CBI court.
On Friday (July 30), news agency ANI tweeted, “Actor Jiah Khan death case: CBI court will now hear the case pending for 8 yrs. The sessions court, which was conducting a trial against her boyfriend actor Suraj Pancholi on charges of alleged abetment, has said that the trial should be transferred to a spl CBI court.”
The Pancholis are relieved that the trial will finally get expedited and everyone will find due closure. Advocate Prashant Patil, who represents Sooraj Pancholi in the trial says, “The order granted by the Hon’ble Sessions Court to transfer the said case to Special CBI Court is a welcome move for my client, Sooraj Pancholi. We have been moving applications since the beginning of the trial to expedite the case and decide the matter on its merits within six months. Our applications were allowed. Even then, the trial proceedings were delayed. We then moved a Writ Petition before the Hon’ble Bombay High Court for expediting the trial and concluding it within six months. The matter now is transferred to Hon’ble CBI Court which according to law is the correct legal position. We are confident now that the matter shall be expeditiously conducted and concluded. If the prosecution has faith in their allegations against my client, it should conduct the trial on a day-to-day basis and prove the guilt of my client. Procrastinating justice only hurts the basic principle of criminal jurisprudence. On the next date we shall move an application to expedite proceedings of the trial on a day-to-day basis before the Hon’ble CBI Court.”
Speaking to a leading daily, Pancholi’s mother Zarina Wahab said, “We wanted this trial to be expedited. Eight-nine years is a very long time. My son has suffered through this period and this was not fair to him. My husband and I and all our family members had faith in God and the judiciary. We all believe that if my son is guilty, he should be penalised, but if he is not, he must also get his clean chit from the Court. He should have the right to move on. I feel bad for my baccha for what he has endured. I also feel the pain of the mother who lost her daughter.”
On June 3, 2013, Jiah Khan was found hanging from a ceiling fan at her apartment in Mumbai’s Juhu. Before her death, the actress was in a relationship with actor Sooraj Pancholi. A six-page suicide note allegedly addressed to her boyfriend, Sooraj Pancholi, was found by the actress’ sister. The letter indicated that Jiah planned to end her life and also wrote about some friction between her and Sooraj.
The mysterious case of her death remained in news for the longest time and the investigation was led by CBI. Her mother Rabiya Khan and family members alleged that she was killed and not committed suicide as perceived.
